ABC’s Notorious might gain a rather, well, notorious designation.

The network has cut the legal drama’s episode order from 13 to 10 episodes.

Notorious has been struggling mightily in the ratings on Thursday nights, averaging only 5.9 million viewers and a 1.4 rating when including DVR.

ABC emphasizes the show is not officially canceled, and that all 10 episodes will air. But in general, freshman shows don’t get their episode orders cut when a network plans to keep the show going beyond that. Sometimes a show’s performance will improve in the ratings and they’ll receive an extension, but it is rare.
