Robert Durst has been officially charged with first-degree murder.

Los Angeles prosecutors have charged the subject of HBO’s documentary series The Jinx with the 2000 death of Susan Berman.

The New York real estate heir was arrested Saturday by FBI agents in New Orleans and is being held without bail. Prosecutors have been working with the LAPD for the past two years investigating the cold-case murder of Berman, a writer and Durst’s longtime friend, whose body was discovered in her Benedict Canyon home on Christmas Eve.

Durst agreed to be extradited to L.A. at a court appearance Monday. The capital murder charge, noted the L.A. County District Attorney’s office, makes Durst eligible for the death penalty, but it won’t be decided until later whether prosecutors actually seek the death penalty.

The official charge is for one count of first-degree murder “with the special circumstances of murder of a witness and lying in wait and gun use allegations.”
