Daryl Hall and John Oates are pretty funny guys, as Oates’ relationship with the comedy musical duo Garfunkel and Oates will attest, but don’t step to them with a pun on their name if you’re looking to use it to sell a product. Brooklyn granola makers Early Bird Foods found that out the hard way when they were slapped with a lawsuit from the smooth-rocking duo over their oats-related product Haulin’ Oats.

This isn’t the first time the pair has taken action against companies who’ve borrowed their song titles. As the musicians’ complaint states, “Over the years, various third parties have attempted to trade off of the fame and notoriety associated with the Artists and Plaintiff’s marks, including by attempting to make a connection between the Artists’ names and oats-related products.”

When reached for comment by email, Early Bird owner Nekisia Davis replied “Say it isn’t so,” and added that Internet orders of Haulin’ Oats can get 25 percent off through the weekend by using the discount code SAYITISNTSO.
