Court to reconsider 'wardrobe malfunction' fine

A federal appeals court will consider reinstating the FCC fine against CBS over Janet Jackson’s “wardrobe malfunction” at the 2004 Super Bowl halftime show after throwing it out two years ago, the Associated Press reports. The 3rd U.S. Circuit Court of Appeals in Philadelphia will take up the matter once again today, ruling on whether the $550,000 fine should stand in light of another case that said the FCC could threaten fines for even very brief moments of profanity such as the flash of Jackson’s breast. In 2008 the same court decided the federal agency had been wrong in levying the large fine for the half-second incident.
